Summer greetings to all from Florida (and from our partnership program at Oxford, where I'm teaching Environmental Policy and Natural Resources Law this summer)! In this newsletter, we are extremely proud to share that FSU's environmental law program has gained in all ranked categories assessed by U.S. News and World Report. We are again recognized as a Top 10 program among public universities, a Top 20 program nationally, and the top environmental law program in the state. Moving up in all three categories, we were ranked as the 7th best program among American public universities this year, we tied as the 17th best program among all law schools nationally, and we are the top ranked environmental law program in the state of Florida.
Here in Florida, we are accustomed to hot weather-but this summer has been intense even for us, and we hope that everyone is finding ways to enjoy and/or beat the heat this season. The fact that extreme heat domes are emerging over so many parts of the globe is suggestive of the environmental challenges with which our students and alumni will continue to grapple. To that end, we congratulate our students who graduated this Spring with Certificates in Environmental Law, including Christian Brandt, Melissa Gallo, Kevin Griffin, Andrew Lanza, Ashley Landwerlen, Hilary Porter, and Ryan Stocks. Among these, Griffin and Lanza graduated with Honors, Gallo and Porter with High Honors, and Landwerlen with Highest Honors.
As we wish our graduates well, we also look forward to meeting the incoming students who will join us in the new school year, which will once again feature a dynamic slate of environmental, energy, and land use law classes and a host of engaging enrichment events for our students and the wider FSU and legal communities. A new edition of the accompanying reference book, Ocean and Coastal Management Law in a Nutshell, was also released.

The Center is gearing up for another year of exciting Enrichment Events. On October 30, the Center will welcome Gerald Torres, Professor of Environmental Justice at the Yale School of the Environment and Professor of Law at the Yale Law School, to deliver the FSU Law Fall 2024 Distinguished Environmental Lecture, Environmental Justice: Environmental Joy. In his lecture, Professor Torres will explain how the primary objective of most environmental and climate initiatives is to alleviate suffering and enhance well-being, and explore and celebrate how environmental justice achieves these goals. The aim is to assist the field of environmental and climate justice in discovering and enhancing practices that reduce harm and promote well-being. As always, the Fall 2024 Distinguished Environmental Lecture will be open to the public and livestreamed for those that cannot attend in person.
Additionally, on October 2, Amanda Shanor, Assistant Professor of Legal Studies & Business Ethics and the Wolpow Family Faculty Scholar at the Wharton School of the University of Pennsylvania, will join us via Zoom to deliver a lecture. Her talk will be open to the public.
Finally, on November 13, we will host a Career Panel featuring practicing attorneys from the public and private sector to share their experiences with our students.

Spring 2024 graduate Kevin Griffin's publication catalog continues to expand. His paper, Atoll for the Ocean: Can Federal Action Protect the Rainforest of the Seas, was published by the Environmental Law Section (ELS) of the Florida bar in the June edition of the ELS Newsletter.
Additionally, Griffin was awarded the Raising the Bar Professionalism Award at the FSU Law Graduation Ceremony. The award is voted on by members of the graduating class, and is given to a student who has shown tenants of professionalism such as positivity, integrity, honesty, strong work ethic, good character, civility with colleagues, a desire to help others, and a sense of humor.

Spring 2024 graduate Lindsay Peterson recently had her article, Participation in Paradise: Indigenous Participation and Environmental Decisionmaking in Hawai'i, 12 Am. Indian L.J. (2024), published in the American Indian Law Journal. The article explores the current state of participation in environmental management decisionmaking by federally recognized sovereign tribes, and argues that federally recognized tribal sovereignty would allow Native Hawaiians to achieve Citizen Control, the highest degree of citizen participation in Arnstein's Ladder Model of Participation, in environmental management decisionmaking.

FSU Law's Environmental Law Society's board members are staying busy this summer through opportunities around Florida. ELS President, Zachary Roper, is a rising 3L currently working with the Department of Environmental Protection, in the Onsite Sewage Program as an Environmental Consultant, where he performs legal research on issues the program encounters as it tries to develop a state-wide septic regulatory regime. Vice President, Matthew Scarbrough, is a rising 2L who interned with a federal magistrate judge at the Middle District Court in Orlando, where he worked on drafting documents for the court and got to observe judicial proceedings. Treasurer, Alyssa Gagnon, is a rising 3L who is working as a Summer Associate at Hall Booth Smith, P.C. in Tallahassee, FL. Secretary, Karla Armstrong, is a rising 3L who is working as a summer law clerk at the Monroe County Attorney's Office for the Board of County Commissioners in Key West, FL, where she researches legal questions surrounding local government takes work field trips to Fort Zachary Taylor, and occasionally deals with chickens crossing the road.

Floyd Self, JD (Class of '86), was recently elected as the President-Elect of the national Energy Bar Association (EBA). His term as president will begin in May 2025. In addition to his practice as a partner in the Tallahassee office of Berger Singerman, Self sits on the Board of the Southern Chapter of the EBA, a member of Leadership Tallahassee Class 20, a past Board Chair and past Curriculum Chair for Leadership Tallahassee, and a co-founder and past Curriculum Chair of Youth Leadership Tallahassee. Supreme Court Overrules Chevron

In a profoundly impactful and long expected/dreaded decision, the Supreme Court has overruled the Chevron doctrine. The majority opinion in Loper Bright Enterprises et al. v. Raimondo, Secretary of Commerce, authored by Chief Justice Roberts, held that "courts need not and under the [Administrative Procedures Act (APA)] may not defer to any agency interpretation of the law simply because a statute is ambiguous." Instead, courts "must exercise their independent judgment in deciding whether an agency has acted within its statutory authority, as the APA requires." In short, no more deference to agencies in interpreting the statutes they administer. The Court pointed out, however, that it's decision does "not call into question prior cases that relied on the Chevron framework."
In dissent, Justice Kagan argues that in "one fell swoop, the majority today gives itself exclusive power over every open issue-no matter how expertise-driven or policy-laden-involving the meaning of regulatory law." The deference the Court has now done away with existed "because agencies often know things about a statute's subject matter that courts could not hope to. The point is especially stark when the statute is of a 'scientific or technical nature.'"
Regardless of one's opinion on the correctness of Chevron in the first instance, the Court's opinion in Loper Bright will greatly impact the pratice and teaching of administrative law. Federal agencies have been afforded, for more than four decades, deference in their interpretation of the statutes they administer when those statutes contain holes or ambiguities. Given the impossibility for Congress to write statutes that are comprehensive in technical and policy detail, courts will now be put in exceptionally difficult positions to determine, without expertise, whether the correct choice was made by the agencies. The myriad decisions that have relied on Chevron over the years highlights this challenge. As Justice Kagan explained, how is a court to decide when "does an alpha amino acid polymer qualify as a 'protein,'" or when is one squirrel population "distinct" from another? Loper Bright (Kagan, dissenting). In a much more recent example of courts' lack of scientific and technical expertise, the day before Loper Bright was released, Justice Gorsuch repeatedly confused the laughing gas "nitrous oxide" for the poison "nitrogen oxide" in his majority opinion in Ohio v. Environmental Protection Agency.
The challenge for agencies and courts was then amplified by the Court's decision, the following day, in Corner Post, Inc. v. Board of Governors of the Federal Reserve System. That opinion, authored by Justice Barrett, held that the statute of limitations for challenges under the APA does not begin to run until the plaintiff is injured by final agency action. Consequently, a plaintiff might bring a facial challenge to a final rule or regulation many decades after it was promulgated. Thus, Chief Justice Roberts' assurance that Loper Bright does "not call into question prior cases that relied on the Chevron framework" provides little comfort for agencies, whose older rules nevertheless might be challenged anew by a newly formed corporate entity claiming an injury from the rules.
