joined the Program as an Attorney Advisor and Visiting Professor. In managing the Division of Air Resources, McLane manages the development of Florida’s State Implementation Plan (SIP) under the Clean Air Act, coordinates with the U.S. Environmental Protection
Agency, manages grant program development, and oversees the Air Resource Division budget. He will share his expertise on practicing public environmental law as one of our featured alumni panelists in the Spring Careers Panel to be held at the Law School on
January 18, and he is currently available to counsel students one-on-one through the Career Services Center. Next academic year, he will begin teaching courses in the areas of his expertise, including
<i>Florida Environmental Law </i>and a seminar on the <i>Air Quality Management and the Clean Air Act</i>.

two weeks, participants – including heads of states, delegates, and observers – met to discuss and negotiate the global community’s continued response to climate change,
</span></span><span class="e2ma-style"><i><span style="font-size:10.5pt;font-family:"Verdana",sans-serif;color:#782F40">“</span></i></span><span class="e2ma-style"><i><span style="font-size:10.5pt;font-family:"Verdana",sans-serif;color:#333333"><a href="https://urldefense.com/v3/__https:/t.e2ma.net/click/dowgud/dkt3efj/1ys39h__;!!PhOWcWs!wN-WWZreQ_lAkB_FWn5Y1Cvx90PbHb1qPw2Pds0HAOz24gbqpk3L0Y3sOrcwYSUNClgq9skVFhAqyCkDCA$"><span style="color:#782F40">with

<span style="color:#782F40">decisions</span></a>, including the final <a href="https://urldefense.com/v3/__https:/t.e2ma.net/click/dowgud/dkt3efj/xju39h__;!!PhOWcWs!wN-WWZreQ_lAkB_FWn5Y1Cvx90PbHb1qPw2Pds0HAOz24gbqpk3L0Y3sOrcwYSUNClgq9skVFhBZEE47Yg$">
<span style="color:#782F40">Implementation Plan</span></a>, regarding climate change mitigation and adaptation. Responses to the COP’s decisions have been mixed, at best. Many in the climate change community are frustrated by the COP’s failure, once again,
to call for the phase-out of all fossil fuels or set more aggressive emissions reduction requirements to ensure the world can meet the Paris Agreement’s goal of limiting warming to 1.5 degrees Celsius. As
<a href="https://urldefense.com/v3/__https:/t.e2ma.net/click/dowgud/dkt3efj/dcv39h__;!!PhOWcWs!wN-WWZreQ_lAkB_FWn5Y1Cvx90PbHb1qPw2Pds0HAOz24gbqpk3L0Y3sOrcwYSUNClgq9skVFhD0yI2anA$">
<span style="color:#782F40">explained by the UN Secretary-General, António Guterres, in his concluding statement</span></a>:
<i>“We need to drastically reduce emissions now – and this is an issue this COP did not address.”</i></span><br>
<br>
<span class="e2ma-style">Instead, the final Implementation Plan calls only for the “phasedown of unabated coal power” and the “phase-out of inefficient fossil fuel subsidies,” while simultaneously advocating for a transition to “low emissions” and renewable
energy sources. Some worry that the undefined term “low emissions” provides a <a href="https://urldefense.com/v3/__https:/t.e2ma.net/click/dowgud/dkt3efj/t4v39h__;!!PhOWcWs!wN-WWZreQ_lAkB_FWn5Y1Cvx90PbHb1qPw2Pds0HAOz24gbqpk3L0Y3sOrcwYSUNClgq9skVFhCPq7gj0g$">
<span style="color:#782F40">“significant loophole” that “could be used to justify new fossil fuel development against the clear guidance of the UN Intergovernmental Panel on Climate Change (IPCC) and the International Energy Agency (IEA).”</span></a></span><br>

<span class="e2ma-style">On the other hand, COP 27 did deliver one important breakthrough: an agreement, at last, to create a
<a href="https://urldefense.com/v3/__https:/t.e2ma.net/click/dowgud/dkt3efj/9ww39h__;!!PhOWcWs!wN-WWZreQ_lAkB_FWn5Y1Cvx90PbHb1qPw2Pds0HAOz24gbqpk3L0Y3sOrcwYSUNClgq9skVFhBNdWmvjA$">
<span style="color:#782F40">“loss and damage” fund</span></a> that will provide to developing nations – those that have contributed the least to global warming but often suffer the most from its consequences – funding from developed nations to respond to losses
and damages from climate change. The agreement to create the fund, however, is short on details. Instead, it provides that a “Transitional Committee” of members will begin consulting in March 2023, and will then provide recommendations to the 28th COP, which
is set to take place in The United Arab Emirates in November 2023. Consequently, whether those recommendations will be sufficiently robust, or even adopted, is yet to be seen.
